Welcome to the Locust Valley Homeowner’s Association (LVHOA) Website. If you continue to browse and use this Website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this Website. If you do not accept these Terms and Conditions you must immediately stop using this Website.
 
This Website has been designed to be the primary means of communications within our community. We encourage you to check this Website daily.  The Website is accessible on computers, cell phones, browsers, and tablets. While the navigation of the Website will differ among those devices, the content remains the same.
 
Privacy Policy
We are committed to keeping your personal information private. The Locust Valley Homeowners Association will not sell, distribute or share any personal information you provide. Any personal information we possess will be used for the sole purpose of administering the relationship between yourself and the Locust Valley Homeowners Association.
 
Changes to Privacy Policy
The Locust Valley HOA Executive Board may make changes to this policy from time to time. It will post changes to the privacy policy on the Website. Residents should check the Website periodically for changes to the privacy policy. The Executive Board may also decide to notify residents by email of significant changes. Any changes to this policy will be effective immediately after being posted.
 
Property Owner Information
The Locust Valley HOA Website provides a directory of resident information including name, address, telephone number(s) and email address(es). This information is kept on limited access servers and is only available to residents and authorized designees with proper user names and passwords. Any Locust Valley HOA resident has the option to not have their personal information displayed on the Community Directory. However, resident information must stay current with the Locust Valley HOA Website Administrator at the following address: locustvalleyhoa2024@gmail.com in order to be available for any Locust Valley HOA business communication.
 
The Executive Board will share Website and Locust Valley HOA resident information with governmental authorities when legally required to do so and may cooperate with these authorities investigating claims of illegal activity such as, but not limited to, illegal transfer or use of copyrighted material or postings or email containing threats to third parties. No Locust Valley HOA resident shall provide access to the online directory of residents to any unauthorized party for any reason whatsoever.
 
 
1. Acceptance of Terms
By accessing and using this Website (“Site”) operated by the Locust Valley HOA you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using the Site.
 
2. Changes to Terms
Locust Valley HOA reserves the right to update, modify, or revise these Terms and Conditions at any time without prior notice. Continued use of the Site after any changes constitutes acceptance of the revised terms.
 
Certain areas of the Site may require account registration. Users agree to:
  • Provide accurate and up-to-date information during registration.
  • Users shall:
    • Treat other homeowners respectfully when participating in forums or online discussions
    • Avoid posting defamatory, offensive, or inappropriate content
    • Adhere to all Locust Valley HOA Rules and Bylaws when interacting through the Site
This Site may include links to third-party Websites for convenience. The Locust Valley HOA is not responsible for the content or policies of these external Websites. Therefore, access them at your own risk.
 
3. Disclaimer of Warranties 
The Site and its content are provided on an “as is” basis without warranties of any kind, express or implied. Locust Valley HOA makes no guarantees about the accuracy, reliability, or availability of the Site.
 
4. Editorial and Content Authority
The Executive Board will designate and choose Locust Valley HOA Website Administrators. The Website Administrators will have editorial authority and content control over the Locust Valley HOA Website. The email messaging system and any other medium used by Locust Valley HOA to communicate to the residents are subject to these guidelines and policy. The Website Administrators reserve the right not to publish notices or information that are not of general interest to the community or will reflect negatively on Locust Valley HOA. Similarly, Locust Valley HOA Website Administrators reserve the right to modify or withdraw any communications previously posted on the Locust Valley HOA Website.
 
5. Published Information
The Locust Valley HOA has adopted the following guidelines with regard to notices and all published material for the Locust Valley HOA Website and email messaging system. The Locust Valley HOA Communications Committee may disseminate the following types of information:
  • Community events
  • Directory of residents
  • Executive Board minutes and financial reports
  • Community announcements
  • Resident submitted announcements that are of general interest to the community
6. Political Content
Content that reflects national, state or local partisan political subjects will not be published. No national, state or local candidate or political party will be endorsed.
 
7. Objectionable Content
Objectionable or illegal products or services will not be advertised or otherwise supported via the Locust Valley HOA communications. No material that is defamatory, obscene or indecent, or that promotes the violation of or violates any legal rights, shall be published or transmitted in any communications via Locust Valley HOA's Website.
 
8. Editorial Discretion
All materials submitted for publication are subject to approval and edit by the Locust Valley HOA Website Administrators. In the event of substantive editing, the submitter may be requested to review the final communication before publication in order to assure factual accuracy; otherwise, the final product generally will not be subject to additional review.
 
9. Religion
Specific religions or houses of worship will not be endorsed through any communications and/or publications via Locust Valley HOA's Website and/or email messaging system.
 
10. Infringement on Intellectual Property Rights
As a condition to the posting of any information provided by a Locust Valley HOA resident, the resident requesting the posting represents and warrants to the Locust Valley HOA that such resident will not post or request posting of any information that infringes on the trademark, copyright or other intellectual property rights of any other person or entity. The resident requesting such posting agrees to indemnify and hold harmless the Locust Valley HOA from all costs and expenses (including attorneys' fees) incurred by the Locust Valley HOA related to or arising from any breach of this representation and warranty.
 
Additionally, the Locust Valley HOA name, logo, and any related designs and slogans are Locust Valley HOA trademarks, and no resident shall use them in a manner that expresses or implies sponsorship by, endorsement by or affiliation with the Locust Valley HOA, on any posts or communications without prior written authorization.
 
11. Copyright Takedown Notification
Generally, the Locust Valley HOA will not be responsible for determining whether there has been an infringement on any trademarks, copyrights, or other intellectual property rights. However, if any Locust Valley HOA resident believes that content residing or accessible on the Locust Valley HOA Website infringes  a copyright that they own, they should send a copyright takedown notice to the Website Administrators (at the address below). Similarly, a user who believes they are the wrongful subject of a copyright takedown notice may file a counter notification in writing to the Website Administrators at locustvalleyhoa2024@gmail.com.
 
12. Limitation of Liability
The Locust Valley HOA shall not be liable for any damages arising from:
  • Use or inability to use the Site
  • Unauthorized access to user accounts or data breaches
  • Errors, omissions, or interruptions of the Site’s services
13. Termination
The Locust Valley HOA reserves the right to terminate or restrict access to the Site for any user who violates these Terms and Conditions or behaves inappropriately.
